One of the biggest insurance questions surrounding the Covid-19 Pandemic is whether commercial property policies would respond to a business interruption loss caused by a government suspension brought on by Covid-19.
Recently, a French court found that an order mandating closure of restaurants and bars in response to Covid-19 triggered the AXA policy’s business interruption coverage.
The Hunton Insurance Recovery Blog reported that after this decision, AXA abandoned its position that business interruption was not covered if it was caused by Covid-19. It appears, AXA has accepted that its policy provision is ambiguous and should be construed in favor of coverage for the policyholder. https://www.huntoninsurancerecoveryblog.com/2020/06/articles/covid-19/global-insurer-agrees-to-pay-covid-19-business-interruption-claims/
