In the great State of Florida, contractors are not allowed to serve as both the contractor and public adjuster on a claim. In such cases, insurance companies are filing counterclaims against the contractor seeking a declaratory judgment that the contractor does not have standing to sue because it acted as the public adjuster in violation of Florida Statute Section 626.854. At this stage, it appears this argument is being allowed to move forward.
